BONDS.

AN ACT to authorize the Board of County Commissioners of the County of Albany to issue Bonds for the indebtedness incurred by said Board in the erection of a Court House.

Be it enacted by the Council and House of Representatives of the Territory of Wyoming :

SECTION 1. That the board of the county commissioners of the rity to nego- county of Albany are authorized to negotiate a loan for the amount of indebtedness incurred by the board of the county commissioners of the county of Albany, in the erection of a court house therein; Provided, That the loan shall not exceed the sum of twenty thousand dollars ($20,000).

SEC. 2. That the board of the county commissioners shall issue court house bonds for the amount that may be borrowed, as provided in the preceding section, bearing interest at a rate not exceeding twelve per cent. per annum, to be redeemed by said county within a period not exceeding five years, and not less than one year, which bonds shall be drawn in favor of persons loaning said money, or their order, and shall be signed by the chairman of said board of the county commissioners, and countersigned by the clerk of said county, and registered by the treasurer of said county; Provided, That no bond shall be issued for a less sum than twentyfive dollars ($25,00); and, Provided, further, That said bonds shall not be sold for a less sum than ninety (90) cents on the dollar, and shall only be sold after advertisement for thirty (30) days in some newspaper of general circulation in said county; and Provided, further, That said bonds shall have coupons attached, of annual interest, payable on the first Monday of December of each year, at the treasury of the county.

SEC. 3. That both the clerk and treasurer of said county shall keep a correct register of all bonds issued under this act, which registers shall at all times be open for inspection by the public.

SEC. 4. That at any time after the expiration of one year from the issue of said bonds, or any portion thereof, all of said bonds, or any portion thereof, may be redeemed by the treasurer of said county, under direction of the board of the county commissioners of the county of Albany; Provided, That said bonds shall be redeemed in the order in which they may be issued; and, Provided, further, That after the county treasurer shall have given ten days' notice by publication in some newspaper published in the Terri

tory, and of general circulation therein, of his readiness to pay any such bonds, designating them by number, the same shall cease to bear interest; and Provided, further, That whenever any of said Further probonds or coupons shall be redeemed, or paid, they shall be defaced by writing across said bonds and the coupons thereto attached, the word "redeemed," and the treasurer shall also puncture the sig nature of the chairman of the board of the county commissioners of the county of Albany, and all other signatures thereon, which bonds and coupons so redeemed shall then be filed in the office of the country treasurer.

SEC. 5. That the board of the county commissioners of the sinking fund. county of Albany shall order, and the county treasurer shall on such order of the commissioners, set aside as a sinking fund not less than twenty per cent. of all moneys raised annually by taxation and paid into the hands of the county treasurer for county purposes, except moneys raised for school purposes, to be applied only to the payment and redemption of said bonds and the interest thereon, until the same are all paid and redeemed.

SEC. 6. If any county commissioner, clerk or treasurer of said General procounty, or other person, shall do any act herein prohibited, or not herein authorized, in the issue or redemption of said bonds or coupons, or fail to do any act herein required, he or they shall be deemed guilty of felony, and on conviction shall be imprisoned in the Territorial penitentiary for a term not exceeding ten years, and fined in a sum not less than one hundred dollars, and not exceeding ten thousand dollars; and Provided, further, If any person or persons shall falsely make, forge, counterfeit, or alter, or cause, or procure to be falsely made, forged, counterfeited, or altered, any court house bond or coupon, or shall pass, utter, publish or sell, or attempt to pass, utter, publish or sell, or shall have or keep in his possession, or conceal with intent to utter, publish or sell any such false, forged, counterfeited or altered bond or coupon, with intent to deceive or defraud, or shall knowingly aid or assist in any of the acts aforesaid, every person so offending shall be deemed guilty of felony, and on conviction shall be imprisoned in the Territorial penitentiary for a term of not more than fifteen years, and be punished by a fine not exceeding ten thousand dollars.

CHAPTER 9.

BONDS.

AN ACT authorizing the Building of a Court House and Jail at Evanston, the County Seat of Uinta County, and to Bond the County therefor

Be it Enacted by the Council and House of Representatives of the Territory of Wyoming: ·

SECTION 1. The board of county commissioners of the county of commission- Uinta, is hereby authorized to purchase a site or sites, or receive county legal- the same by donation or otherwise, within the limits of the town of Evanston, in said county, and to secure a deed for the same for the said county for a court house and jail, and that the action of the said board already taken in locating a site and letting contracts for the construction of said court house and jail is hereby legalized, and the said board are hereby authorized to issue bonds of the said county to defray the expenses incurred and to be incurred in the building and completion of said court house and jail, not exceeding the sum of twenty-five thousand dollars.

SEC. 2. Said board of county commissioners is hereby vested court house with full power to make all necessary arrangements and contracts for the building of said court house and jail, in such manner as said board may deem for the interest of said county, and shall exact a bond from the contractor in double the amount of the contract, with good and sufficient sureties, for the faithful execution of such contract.

SEC 3. Said board of county commissioners shall issue court house bonds for the amount mentioned in section one (1) of this act, or so much thereof as shall be sufficient for the purpose contemplated by this act; said bonds shall be issued in sums of not less than twenty-five (25) dollars each, and shall be redeemed by said couuty within a period not exceeding five (5) years, and not less than one (1) year from date of issue, and shall bear interest at the rate of twelve (12) per centum per annum on each dollar of their face. Said bonds shall be regularly numbered from one upwards, and, before being issued, shall be registered in the county treasurer's office of said county and countersigned by the

treasurer.

SEC. 4. The county treasurer of said county shall keep a book shall register in which shall be registered all of said bonds, showing the number of the bond, the date of issue, to whom issued, amount, numbers of coupons, date of redemption, date of registry and payment of interest, which book shall, during business hours, be open to inspection.

SEC. 5. All bonds issued by virtue of this act shall be signed by the chairman of the board of county commissioners of said county, and attested by the county clerk, with the seal thereof attached, and no bond shall be sold for a less sum than ninety Bonds. (90) cents on the' dollar, and shall not be sold until thirty days' notice shall have been given in some newspaper of general circulation in said county.

SEC. 6. Said bonds shall have coupons attached, representing coupons. the interest to be paid each year, and the coupon representing the interest shall be detached from the bond before presentation for payment of the interest for the year corresponding, and shall be forthwith canceled by the treasurer by writing the word "canceled" across the face thereof; and the interest on all bonds shall be payable, at the county treasurer's office of said county, on the first and ten (10) succeeding days of December in each year (Sundays excepted); Provided, That said county treasurer may anticipate said interest, and pay the same at any time during the month of November of each year, if he should have funds in his hands for such purpose, and if, after the payment of interest on said bonds, any surplus remains in the "court house and jail bond fund" hereinafter mentioned, it shall be applied to the redemption of the bonds in the order of their number, commencing with the lowest number.

SEC. 7. There shall annually be levied by the board of county Annual tax. commissioners of said county, on all taxable property therein, a tax not to exceed five (5) mills on the dollar of valuation, which tax shall be known as the "court house and jail bond fund;" and said tax shall be payable only in gold or silver coin, or in United States treasury notes, or National bank notes, and shall be used to pay interest and principal of said bonds, and for no other purpose; and said tax shall be collected in the same manner as other county taxes, and paid into the county treasury by the collector

SEC. 8. Whenever there is five hundred (500) dollars in the Five hundred hands of the county treasurer belonging to the "court house and dollars surjail fund” over and above the amount necessary to pay the used in reinterest on said bonds for the current year, said treasurer shall bonds. notify the holders of the lowest numbered bonds outstanding, by advertisement in some newspaper published in said county, for ten (10) consecutive days (Sundays excepted), or by personal notice at his option, that the bonds (numbering them, giving the amount and to whom issued) will be paid on presentation to said treasurer, and that if said bonds are not presented within thirty days from such personal notice, or the completion of the advertisement, they will fail to draw interest thereafter. Should any bond or bonds mentioned in such notice or advertisement not be presented as above specified, such bonds shall fail to draw interest thereafter, and the surplus fund intended for the payment of said bonds shall be used in the payment of the next lowest numbered bonds not included in said notice or advertisement, and the bonds not presented need not be paid until the following year.

the hands of the county, treasurer. In all cases, said bonds shall be redeemed by the payment of number one, and proceeding consecutively upwards with those outstanding. All bonds, when redeemed, shall immediately be canceled by the county treasurer in such a manner as said board of county commissioners may direct; and whenever there is a surplus of five hundred dollars and over in the "general county fund," said commissioners may direct and transfer the same to the "court house and jail fund," and apply the amount to the redemption of bonds in the manner hereinbefore specified, or may purchase bonds in the open market with the same; Provided, That no money belonging to the general county fund" shall be so diverted or transferred, whilst any county warrants of said county are outstanding.

SEC. 10. All the taxable property of said Uinta county is hereby pledged to the payment of the principal and interest of said bonds in the manner herein prescribed, and it shall not be lawful to use or divert any portion of said "court house and jail fund” for any purpose whatever, except the payment of said principal and interest.

SEC. 11. The county treasurer shall have the custody of all the custody of the funds realized from the sale of said bonds, and shall pay the same out on the written order of said board of county commissioners, or a majority thereof, taking the receipt, in every case, of the person in whose favor said order is drawn, which receipt and order shall be his voucher for money so paid out; and said board of county commissioners shall exact of said county treasurer a separate bond in such sum as they may deem proper, on behalf of said Uinta county, with two or more sufficient sureties, conditioned for the faithful performance of the duties required of him by this act, and the faithful accounting for the money deposited with him and realized from the sale of bonds as herein provided for.

SEC. 12. The county clerk and county treasurer shall be allowed such compensation for all services rendered by them, under the requirements of this act, as said board of county commissioners may deem to be just and equitable; Provided, That said officers' services, in the collection and disbursement of money for the redemption of bonds and the payment of interest thereon, is not to be included by said commissioners in their estimate for the above compensation, but said officers shall be allowed the same fees, compensation or percentage in the collection and disbursement of the money above mentioned, as may be allowed them respectively in the collection and disbursement of other funds under any law of this Territory.

SEC. 13. All expenses incurred by said board of county commissioners in carrying out the provisions and intention of this act, shall be paid out of the "general county fund" on the order of said commissioners.

SEC. 14. This act shall take effect and be in force from and after its passage.
