CHAPTER 37.

CONTRACTS FOR LABOR.

AN ACT to Prohibit the Enforcing of Certain Contracts for Labor.

Be it enacted by the Council and House of Representatives of the
Territory of Wyoming:

SECTION 1. No contract made for labor or services with any tracts. alien or foreigner previous to the time that such alien or foreigner may come into the Territory, shall be enforced within this affected. Territory for any period after six months from the date of such

contract.

SEC. 2. Any alien or foreigner who shall hereafter perform labor or services for any person or persons, company, or corporation within this Territory shall be entitled to recover from such person or persons, company or corporation, a reasonable compensation for such labor or services, notwithstanding such person or persons, company or corporation, may have paid any other party or parties for the same; and in actions for the price of such labor or services no defense shall be admitted to the effect that the defendant or defendants had contracted with other parties, contracts with who had, or pretended to have, power or authority to hire out the null and void. aliens, when labor or services of such party or parties, or to receive the pay or price for such labor or services.

SEC. 3. Any person, whether he or she, acts for himself or her- tion of act. self, or as agent, attorney or employe for another or others, who shall, in pursuance of, or by virtue of, any contract made with any alien or foreigner, made before such alien or foreigner came into the Territory, receive or offer to receive any money, pay or remuneration for the labor or services of any alien or foreigner, excepting the person so performing such labor or services, [shall] be deemed guilty of a misdemeanor, and, on conviction thereof, shall be fined in a sum not less than five hundred dollars, and not more than five thousand dollars, and imprisoned in the county jail for not less than three, nor more than twelve months, for each and every offense.

SEC. 4. This act shall take effect from and after its passage.

CHAPTER 38.

CRUELTY TO ANIMALS.

AN ACT entitled "An Act for the Prevention of Cruelty to Animals, and Defining the
Punishment Thereof,"

Be it enacted by the Council and House of Representatives of the Ter-
ritory of Wyoming :

SECTION 1. That any person or persons who may be deemed speci- guilty of over-driving or riding (except in cases of sickness or necessity) any mare, gelding, mule, or ass, or other domestic animal, or by over-loading the same, or abuse by beating, or otherwise punishing the above animals, whereby damage is done, or sickness or death may ensue; the said person or persons, upon conviction thereof before any justice of the peace (or any other court of justice) of this Territory, shall be made to pay a fine of not less than twenty five dollars, nor more than one hundred dollars for each and every offense, or by imprisonment in the county jail for not less than one month, nor more than three months, or both, in the discretion of the court.

SEC. 2. This act shall take effect and be in force from and after its passage.

CHAPTER 39.

AN ACT to give to the Representatives of Deceased Persons a Right of Action in Certain Cases.

SECTION 1. SEC. 2. Every such action shall be brought by, and in the name Distribut'n of of, the personal representative of such deceased person; and the damages. amount recovered in every such action shall be distributed to the parties and in the proportions provided by law, in relation to the distribution of personal estates left by persons dying intestate. SEC. 3.

This act shall take effect and be in force from and after its passage.

CHAPTER 40.

DEEDS, MORTGAGES, BONDS, &c.

AN ACT to Provide for the Recording of Deeds, Mortgages, Bonds, Contracts, Agreements, &c.

Be it enacted by the Council and House of Representatives of the Territory of Wyoming :

SECTION 1. All deeds, mortgages, bonds, contracts, agreements, or other instrument concerning any interest in lands in this Territory, made in writing, under seal, attested by two witnesses and acknowledged before some person authorized by law to take acknowledgments of deeds, shall be recorded in the office of the register of deeds of the county where the land lies, within three months of the date of such instrument.

SEC. 2. It shall be the duty of the register of deeds of each county within this Territory, to receive and record at length all such deeds, bonds, mortgages, contracts, and agreements, as shall be left with him for that purpose.

SEC. 3. Each and every instrument touching any interest in recorded to be lands, made and recorded according to the provisions of the first section of this act, shall be notice to, and take precedence of, any subsequent purchaser or purchasers, from the time of delivering said instrument at the office of the register of deeds for record.

SEC. 4. This act shall take effect and be in force from and after its passage.

CHAPTER 41.

DEPOSITIONS.

AN ACT providing for the Appointment of Commissioners to take Depositions in other
States and Territories.

Be it enacted by the Council and House of Representatives of the Ter-
ritory of Wyoming:

SECTION 1. The governor may appoint, in each of the United Appointed by States and Territories, and in the District of Columbia, one or governor. more commissioners, to continue in office during the pleasure of the governor for the time being, and every such commissioner shall have power to administer oaths and take depositions and affidavits, to be used in this Territory, and also to take the acknowledgments of deeds, powers of attorney, or other instruments to be recorded in this Territory.

SEC. 2. All oaths administered by the said commissioners, all Oaths, etc,, efaffidavits and depositions taken by them, and all acknowledgments fectual in law aforesaid, certified by them, shall be as effectual in law, to all intents and purposes, as if done and certified by any authorized officer within this Territory.

SEC. 3. Before any commissioners, appointed as aforesaid, shall Oath taken proceed to perform any of the duties of their office, they shall take and subscribe an oath before any justice of the peace, or other officer authorized to administer oaths in the State or Territory for which such commissioners may be appointed, that they will faithfully discharge all the duties of their office, which oath shall be filed in the office of the secretary of this Territory, within six months after the taking of the same, and also his autograph and impression of his seal of office.

SEC. 4. This act shall take effect and be in force from and after its passage.
