There is a pedigree of Deyville of Cuckwold by Glover which gives some additional information as to the descendants of the third George Deyvill above-named (second son of the second George Deyvill abovenamed). An additional pedigree from M.S. Harl., 1571, gives the descendants of that George's elder brother John. Foster, Yorkshire Visitations, pp. 215, 602.

In 1535, Robert Davell of Coxwold applied for a writ of subpoena to be directed against Edward Brand and others, who, by force of arms, had robbed him of a large part of the tithe grains of Great and Little Thirkelby. Yorkshire Star Chamber Proceedings, pp. 93-5.

The will of Robert Davell, dated 1st December, 1538, and proved 3rd February, 1538-9, is printed in Test. Ebor. vi. p. 76.

Roger Davyll was plaintiff in a fine concerning property in Yorkshire in 1581. Yorkshire Fines, vol. ii. p. 163.

By inq. p.m. taken 27th January, 1594-5, it was found that he died 3rd January, 1585-6, and that Francis, aged 40, was his son and heir. Francis Davell (son and heir of Roger) and Agnes his wife were deforciants to a fine concerning properties in Cuckwold and elsewhere in 1590. Yorkshire Fines, vol. iii. p. 129.

The will of George Deyvill of Coxwold (the third of that name) dated 9th April, 1538, and proved 7th March, 1538 9, is printed in Test. Ebor. vi. p. 75.

William Davell was plaintiff in a fine concerning land in Cockwold in 1545, and deforciant to a similar fine in the same year. William and Christopher Davell were plaintiffs in a fine in 1563, and William Davell and Johanna his wife, were deforciants to a fine in 1565. Yorkshire Fines, vol. i. pp. 116, 119.

Christopher Davell was also plaintiff in a fine concerning lands in Cuckwold and Byland in 1586, and concerning lands in Raskell in 1593. Yorkshire Fines, vol. iii. pp. 50, 201. He is mentioned in the will (dated 23rd January, 1561-2) of James Foxe of Thorpe, whose grandson he was. Yorkshire Star Chamber Proceedings, p. xvi.

Henry Davell, second son of John Davell, was the last abbot of Whitby, which he surrendered in 1540. Whitby Chartulary, Surtees Soc. publ., no. 69, p. lxxxvii.

The will of James Foxe, father of Jane, second wife of William Davell, proved 26th October, 1562, is printed in Yorkshire Star Chamber Proceedings, p. xv.

There is a pedigree of the main line of Appleyard of Burstwick Garth by Glover in Foster, Yorkshire Visitations, p. 146, commencing with John Appleyard of Butterwick (father to Sir John Appleyard of Heslington), who married a daughter of Sir Robert Sheffield. mentions the cadet line of Thomas Appleyard and Thomas his son but does not give the other issue of Thomas (1) nor the wife of Thomas (2). Thomas (1) was mayor of York in 1549-50 and again in 1562-3. Thomas (2) was mayor of York in 1583-4. Surtees Soc., vol. 96, p. 270, and vol. 102, pp. 4, 25.

The reference to the ing. p.m. of Nicholas Appleyard is 38 Hen. VIII, Chancery Series II, vol. 74, no. 55; to that of John (his son and heir) 39 Elizabeth, Chancery Series II, vol. 248, no. 5; and to that of Thomas Appleyard 30 Elizabeth, Chancery Series II, vol. 277, no. 88.

Thomas Appleyard (1) was plaintiff in fines concerning property in Yorkshire in 1561, 1569, and 1577. Yorkshire Fines, vol. i. pp. 255, 375; vol. ii. p. 107. Thomas Appleyard (2) and Peter Appleyard were

deforciants to a fine in 1585, and Thomas (2) and Margery his wife were deforciants to fines in 1590, 1591, and 1593. Yorkshire Fines, vol. iii. pp. 40, 128, 149, and 200. This last named Appleyard was also deforciant to a fine in 1600. Yorkshire Fines, vol. iv. p. 149.

The arms of Appleyard, Sable, a chevron between three owls Argent, a mullet on the chevron for difference, as reproduced, with no colours No tricked, appear in the margin of the manuscript Ashmole 834, III. arms are given in the manuscript H. 19.

GABERELL FAIREFAX, vth sonne to Sir William Fairefaxe of Steton, entred as heire unto all his fathers landes by fyne and recoverey mad unto hym by his saide father in his lyef tyme, and the saide Gaberell maryed Elizabeth, doughter to Robert Aske of Aucton, and by her had yssu WILLIAM Sonne and heire, and Anne.

HENRY FAIREFAX, sixt sonne to Sir William, maryed Dorothe, doughter to Robert Aske of Acton, and by her had yssu GABERELL sonne and heire, Edwarde second sone.

The family entered their pedigree again at Dugdale's visitation in 1666, and references to wills, inquisitions and other evidences relating to the entries in the text will be found in Clay, Dugdale's Visitation of Yorkshire with Additions, vol. ii. p. 186. The marriages of Susan Fairfax are omitted by Mr. Clay.

JAMES, eldest sonne of John lorde Barnes, was a man of armes in Calles and afterwardes lieutenaunt of Hambiltew; and he maryed Mary Banester, sole heire to her brother, John Banester, which John was sonne and heire to Sir Humfrey Bannester of Calles, and by her had yssu RAFF sonne and heire, Arthur second sonne, Arthur a third sonne, Marye, maryed to Nyccasions Ettiswoorth, [sic], and Jane.

RAFFE, sonne and heire of Jeames, maryed Elizabeth, doughter of Fraunces Hall, esquire, of Grantam, and by her hath yssu WILLIAM first sonne, Urseley, Bridget and Lucey.

John Bourchier, lord Berners, was the translator of Froissart. He left no legitimate male issue.

For "Hambiltew" read Ambleteuse, in the Pas de Calais.

SIR ROBERT STAPLETON of Whyghell maryed Elizabeth, doughter to Sir William Mallarey of Studley, and by her had yssu ROBERT sonne and heire, Elizabeth and Briget.

The pedigree of Stapleton of Wighill recorded by Dugdale and printed in Surtees Soc., vol. 36, pp. 224-5, shows the connection between this family and that of Stapleton of Carleton recorded by Dalton and printed in part i. of this work, p. 115.

Robert Stapleton was plaintiff to a fine concerning lands in Wighill in 1538, and to another fine in 1552. Yorkshire Fines, vol. i. pp. 82, 165. The reference to his ing. p.m. is 4 and 5 Ph. and M. Chancery Series II. vol. 113, no. 35.

Sir Robert Stapleton (his son) was party to fines concerning properties in Yorkshire with Katherine his first wife and Olive his second wife. These fines occur between the years 1571 and 1589. Yorkshire Fines, vol. ii. pp. 9, 10, 31, 48, 99, 100, 103, 181; vol. iii. pp. 33, 35, 87, 97, 114.
